Trademark Registration
& Protection.

Federal trademark registration that secures your brand name, logo, and identity against infringement — with strategic counsel at every stage of the process.

Your Brand Is Your Most Valuable Asset.

A trademark is more than a logo — it's the legal foundation of your brand identity. Roberts Legal Group handles every stage of the trademark process, from initial clearance through federal registration and long-term portfolio management.

01

Comprehensive Clearance Search

Before you invest in a brand, we conduct a thorough search of federal trademark databases, state registrations, and common law usage to assess availability and risk.

02

Application Strategy & Filing

We advise on the strongest class and description of goods/services, draft your application, and file with the USPTO — maximizing your chances of approval on the first attempt.

03

USPTO Prosecution & Office Actions

If the USPTO issues an office action, we respond strategically. Our deep knowledge of trademark law means we can overcome most objections without jeopardizing your application.

04

Registration & Maintenance

Once registered, we help you maintain your trademark — filing required maintenance documents, monitoring for infringement, and managing renewals to keep your protection active.

05

Portfolio Management

For growing brands with multiple marks, we provide ongoing portfolio strategy — identifying gaps, advising on international filings, and aligning IP strategy with business growth.

What Trademark Registration Gives You

01

Nationwide Priority

Federal registration gives you priority rights across the entire United States, not just where you currently operate.

02

Legal Presumption of Ownership

Registration creates a legal presumption that you own the mark and have the exclusive right to use it nationally.

03

The ® Symbol

Use the registered trademark symbol to put the world on notice — and increase the deterrent effect on potential infringers.

04

Customs Protection

Record your trademark with U.S. Customs to block importation of counterfeit goods bearing your mark.

05

Basis for Foreign Filing

Use your U.S. registration as the basis for seeking trademark protection in foreign countries under international treaties.

06

Incontestability

After five years of continuous use and registration, your mark can become incontestable — the strongest form of trademark protection.

Trademark FAQs

How long does trademark registration take?
The USPTO process typically takes 8–12 months for a straightforward application. Complex applications or those requiring responses to office actions can take longer. We keep you informed at every stage.
Can I use ™ before my mark is registered?
Yes. The ™ symbol can be used with any trademark you are claiming rights to, even before federal registration. The ® symbol may only be used after the USPTO has granted registration.
Do I need a trademark attorney, or can I file myself?
While it's technically possible to file on your own, the USPTO requires foreign applicants to use a licensed attorney, and even U.S. applicants benefit greatly from professional filing. Mistakes in the initial application can be costly and difficult to correct.
What can and cannot be trademarked?
You can trademark brand names, logos, slogans, and even sounds and colors in some cases. Purely descriptive terms, generic words, and certain government symbols cannot be registered. We assess your mark's registrability before filing.
What happens if someone copies my trademark?
With a registered trademark, you have powerful tools including cease and desist letters, USPTO opposition and cancellation proceedings, and federal litigation. We advise on the most effective and cost-efficient enforcement strategy for your situation.
